Acceptable Use Policy (AUP)
At SmartDI (Company), we are dedicated to delivering top-tier communication solutions catering to the global business landscape. To ensure the responsible and secure utilization of our Services, we have established the Acceptable Use Policy ("AUP"), which applies comprehensively to all Smart DI D.O.O. Services. By using Company Services, users implicitly agree to adhere to this Acceptable Use Policy (AUP).
The usage of SmartDI D.O.O.'s Services, encompassing devices, systems, networks, or accounts connected to the Services or the Smart DI D.O.O. Network, is strictly prohibited for engaging in any unlawful activities, high-risk endeavors, copyright infringement, exploitation or harm to minors, malicious practices, objectionable content, misrepresentation of origin or identity, unsolicited communications, data harvesting, spamming, excessive or unauthorized usage, evasion of compliance or security measures, or intercepting communications.
Examples of unacceptable activities under the Smart DI D.O.O. AUP include refraining from using the Smart DI D.O.O. Services as the primary means of communication for emergency services, abstaining from relying solely on Smart DI D.O.O. Services for critical business operations with significant potential consequences, and avoiding the use of Smart DI D.O.O. Services for safety-critical applications.
Other prohibited activities involve spamming or sending unsolicited messages without recipients' consent, engaging in fraudulent or malicious activities such as hacking or phishing, violating intellectual property rights, participating in any form of harassment, misrepresenting oneself or the origin of communication, interfering with the Smart DI D.O.O. network or other users' networks, and collecting personal information without consent.
It is important to note that the examples provided above are not exhaustive, and Smart DI D.O.O. reserves the right to determine any activity that violates the AUP. Violators may face disciplinary actions, including termination of their Smart DI D.O.O. Services.
Furthermore, Smart DI D.O.O. users must comply with all applicable local laws and regulations concerning data privacy, telecommunications, and consumer protection. For instance, adhering to the European Union's General Data Protection Regulation (GDPR), the United States' Telephone Consumer Protection Act (TCPA), and Canada's Anti-Spam Legislation (CASL) is imperative. The responsibility lies with Smart DI D.O.O. users to understand and adhere to these local regulations alongside Smart DI D.O.O.'s Acceptable Use Policy.
In addition to the AUP, users should also familiarize themselves with other pertinent regulations, such as CAN-SPAM in the United States, CASL in Canada, and the CTIA Messaging Principles, as non-compliance may lead to service suspension or termination.
SmartDI D.O.O. is committed to promptly addressing AUP violations and may suspend or terminate Services without notice at its sole discretion. Customers have the right to cancel services within thirty (30) days of the effective purchase date and may receive a pro-rated refund of any prepaid and unused fees, subject to the terms of the Agreement.
